Welcome to CreamTea. These Terms of Service ("Terms") govern your access to and use of the CreamTea web application (the "Service"), operated by CreamTea ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
CreamTea is an AI-powered English pronunciation and communication coach. The Service provides real-time voice-based tutoring sessions, post-session pronunciation analysis, vocabulary flashcards with spaced-repetition scheduling, and a personalised memory system that adapts to your learning needs over time.
The Service is designed for educational purposes and is intended as a supplementary learning tool. It does not replace professional language instruction, speech therapy, or academic certification.
You may sign in using your Google account or use the anonymous demo mode. When you sign in with Google, you authorise us to access the account information described in our Privacy Policy.
You are responsible for maintaining the security of your Google account credentials. You agree to notify us immediately of any unauthorised use of your account.

During coaching sessions, the Service records your voice for pronunciation analysis. By using the Service, you consent to this recording. You retain ownership of your audio recordings and any content you provide during sessions.
You grant us a limited, non-exclusive licence to process your audio recordings and session content solely for the purpose of providing and improving the Service, including pronunciation assessment, vocabulary extraction, and memory consolidation as described in our Privacy Policy.
The Service uses artificial intelligence to provide coaching, feedback, and language assessments. You acknowledge that:
The Service may impose usage limits, including limits on session duration, number of sessions, or token consumption. These limits may vary based on your account type and are subject to change. We reserve the right to throttle or suspend access if your usage significantly exceeds normal patterns.
The Service, including its design, code, AI models integration, and branding, is owned by CreamTea and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
The Service relies on third-party providers including Google (Firebase, Gemini API), Microsoft (Azure Speech Services), and Anam AI (avatar rendering). Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or conduct of third-party services.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, CreamTea and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, regardless of the theory of liability.
Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.
You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" at the top of this page and, where appropriate, notify you within the application. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
